The Failure of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension sparked by the presentation of a new 28-point plan for achieving ceasefire appeared – momentarily – to have been stabilised. A Washington representative spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Moscow made its retaliation: an extensive attack of rocket attacks on Kyiv.

The Cycle of Negotiation and Warfare

The succession of conflicting incidents captured the grim essence of the current period. By day, political struggles are fought: optimistic declarations are issued from multiple capitals. Significant resources is devoted on restraining particular approaches. By night, Russian leadership brutally reminds the world that, for them, military action persists as the main instrument for achieving "settlement".

Nighttime Reality

As the offensive progressed into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was exposed. Ukraine is equipped to monitor rocket firings from across the border, a capability afforded by current data. From observation points, Ukrainian air force fighter jets that had been deployed to counter approaching guided weapons streaked across the sky – modern combat jets provided to Ukraine by Western partners.

Soon thereafter, Kyiv's anti-aircraft weapons activated: defensive missiles targeted at a hostile projectile. This was a sophisticated defense system at work, most likely supplied through partner states. Every launch creates sudden vibrations, causing tremors. The brief panic quickly transforms into resigned acknowledgment: perhaps the approaching threat won't cause damage this time, protecting urban areas from devastation and another blackout.

Continuous Dangers

Following this, a heavy machine gun engaged a drone somewhere nearby, part of a defensive team – almost certainly Western-made equipment. Sadly, the shots failed to hit the enemy aircraft – it pressed on overhead toward its destination.

Intermittently, this carried on until dawn. Kyiv awoke to the early updates: multiple fatalities, destruction and infrastructure problems in many homes as a result of the nocturnal offensive. As typically, everyone still went about their day – living the war. But those 24 hours encapsulated Ukraine's essential dependence on international aid – a dependence that neighboring countries are demonstrably unable to replace in the immediate future.

Failed Diplomacy

The 28-point plan from American leadership sparked intense emotion, debate and serious worry – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new initiative from American administration adheres to the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with allied governments, effectively counters. They stabilise the situation but never actually secure success. This trend will, no doubt, endure.

Tactical Assessments

It is convenient to criticize particular leaders of consistently pushing Moscow's conditions. But that does not seem to be the whole story. US administration operates on a principle well known to seasoned negotiators: you cannot secure via talks what you have been unable to protect through force. The US administration assumes that it is unfeasible to compel Moscow to relinquish the land that it currently occupies in Ukraine's south or east.

The problem is that while acknowledging this situation, Washington does little to discourage Russia, through diplomacy or military means, from assuming that the current condition will not evolve additionally in its benefit in the coming year.

Opposing Positions

Therefore, Russian leadership is certain that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their incentive to sign a deal that does not give them the largest achievable advantage is almost completely absent. There may be many attempts to stop fighting, but they will continue as long as Russia's government remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still endure, progressively conceding civilians and areas but averting a total frontline collapse until conditions improve in its favour.

Present Conditions

Factually, there are no actual prerequisites for a ceasefire. Now, individual motivations are coming into play: political desires to broker a ceasefire and obtain worldwide acknowledgment, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the flag against any proposal Kyiv finds unsuitable, so that their priority does not shift toward domestic problems. And although their task will now be considerably more difficult after latest incidents, it remains quite doubtful that this will change their overall approach.

These two forces are guiding negotiations.

Conclusion and Outlook

It took a just a single week to terminate the proposed articles of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the other European countries, along with soothing efforts of representatives, and finally, recent disclosures, all did their job.

While new plans based on previous concepts are imminent, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are based on Russian demands and reflect particular unwillingness to modify developments, if they remain united and enhance their military capacity at a much faster pace. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the predictable period, largely rely on sustained allied backing.
